This Privacy Statement describes how we process your personal data as a Data Controller in the course of our operations. It also describes certain privacy rights and data protection laws that may apply to you. When we collect and otherwise process your personal data on behalf of our client, we are acting as a Service Provider under the California Privacy Rights Act (“CPRA”) and a Processor under EU data protection laws or other US state comprehensive privacy laws (as applicable). We process and retain your personal data in accordance with the data processing agreement in place with our client. Our agreements with our clients prohibit us from using that information, except as necessary to provide our services to our client or to comply with applicable law.
Where we process your personal data in our capacity as a Processor/Service Provider, and you seek to submit a privacy rights request, we will provide your request to our client (or the ultimate data controller), or you can contact them directly and we will cooperate with the client to facilitate your request.

Data Controllers

What Personal Data Do We Collect From You?

From providers of goods and services to McGuireWoods Consulting, we collect limited information that could be considered personal data. The information we collect from you may include the following:
- Personal identifiers (your name and contact details, like address, home and mobile phone numbers, email address); and
- Financial account information (your bank account details should we need to transfer funds to you).
Visitors to the Website
As a visitor to our main internet site, www.mwcllc.com, or any other website or web address operated by or on behalf of McGuireWoods Consulting that links to this Privacy Statement (the website), we collect information that you submit to us when you interact with features of the site such as subscribing to news alerts, completing a form, or signing up to attend firm-sponsored events. When you do this we collect:

- Professional or employment-related information (role, employer).
In addition to collecting information you provide, our website automatically collects the following information for purposes of analytics and marketing:

- We use Meta Pixel to customize our advertising and to serve you ads on your social media based on your browsing behavior. This allows your behavior on our website to be tracked. Meta stores cookies on your device to enable us to measure the effectiveness of Meta ads for statistical and market research purposes. We do not have access to the information collected through Meta’s cookies. However, the information collected via Meta, on the Website as well as other websites on which Meta’s cookies are installed, is also stored and processed by Meta. Meta may link this information to your Meta account and also use it for its own promotional purposes in accordance with Meta’s Data Usage Policy. The Meta cookies also allow Meta and its partners to show you advertisements on and outside of Meta. This may be deemed a sale or sharing under state data privacy laws. To opt-out of this sale or sharing and the processing of personal information for purposes of targeted advertising, visit your Facebook Advertisement Preferences, and you can clear and control the information third parties share with Meta in your Off-Facebook Activity page. - We use the LinkedIn Insight Tag, which enables the collection of data regarding your visits to our Website, including the URL, referrer, IP address, device and browser characteristics (User Agent), and timestamp. The IP addresses are truncated or hashed (when used for reaching members across devices), and LinkedIn members’ direct identifiers are removed within seven days in order to make the data pseudonymous. This remaining pseudonymized data is then deleted within 180 days. The information collected through the Insight Tag is used to improve reporting on campaign performance. You are not able to opt out of ads on LinkedIn, but you can visit LinkedIn Advertising Preferences to choose how data is used. The use of this information for analytics and advertising purposes may be considered a sale or sharing under state data privacy laws. Purpose and Legal Basis for Processing
When processing your personal data, the purpose and legal basis include the following, to the extent that they apply to you:

How Long Do We Keep Your Data?
Your personal data is kept for the time required to pursue the purposes disclosed in this Privacy Policy, including for the purpose of satisfying any applicable legal, professional, contractual, regulatory, accounting or reporting requirements unless you have requested deletion and we have honored that request.
If you request that we stop sending you marketing materials, we will continue to keep a record of your contact details and appropriate information to enable us to comply with your request not to be contacted by us.

We will retain your personal data only for as long as necessary to fulfil the purposes disclosed in this Privacy Policy, including for the purposes of satisfying any legal, accounting, legitimate administrative or operational purposes, and any reporting requirements. In determining data retention periods, we take into consideration local laws, contractual obligations, our professional duties to our clients, our reasonable business requirements, and your expectations and requirements.
When it is no longer necessary to retain your personal data, we will securely delete or, in some circumstances, anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further statement to you. Any such anonymization would be performed in accordance with, and where allowed by, applicable law.
Disclosing Your Personal Data
This website is hosted in the United States. Personal data that is voluntarily provided on or via this website or online, via electronic communication, or otherwise to McGuireWoods Consulting, may be maintained or accessed in servers or files located in the United States.
To provide legal services and effectively run our business, we may need to disclose your personal data as permitted by law. Transfer of personal data may occur internally between McGuireWoods Consulting and/or McGuireWoods LLP offices, to our providers as necessary to provide our services, or to public and regulatory bodies in the event we are required to do so. These transfers may involve international transfer of your personal data to our McGuireWoods LLP offices (including our offices located outside the European Economic Area (EEA)) and data centers or those of our providers or public and regulatory bodies.
We may, however, disclose your personal information with service providers or third parties in accordance with the business purposes set out in this Privacy Statement. At this time, the firm’s website does not have the ability to respond to “Do Not Track” signals sent by individual users’ web browsers.
Disclosure of Personal Data to Service Providers
We disclose and have disclosed in the preceding 12 months personal data to our service providers and contractors for the following purposes.
- Auditing of Ad Impression: We disclose personal data for auditing purposes to our marketing service providers related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.
- Security and Fraud Detection: We disclose personal data to our IT service providers for our security and fraud detection services including detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity; and prosecuting those responsible for that activity.
- Functionality & Debugging: We disclose personal data to our IT service providers to engage in debugging to identify and repair errors that impair existing intended functionality.
- Short-Term / Transient Use: We disclose personal data for short-term, transient use to our affiliates, marketing, analytics, and IT service providers, including, but not limited to, non-personalized advertising shown as part of a consumer’s current interaction with the business, provided that the consumer’s personal data is not disclosed to another third party and is not used to build a profile about the consumer or otherwise alter the consumer’s experience outside the current interaction with the business.
- Services on Our Behalf: We disclose personal data in order to receive services performed on our behalf, including service providers maintaining or servicing accounts, providing client service, verifying client information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on our behalf.
- Advertising and Marketing Services: We disclose personal data marketing services providers to provide advertising or marketing services on our own behalf.
- Research & Development: We disclose personal data to our affiliates and analytics service providers for internal research related to technological development and demonstration.
- Quality Control & Improvement of Products and Services: We disclose personal data to our affiliates, IT, and analytics service providers to verify, maintain, and improve our products and services.

We do not sell your personal data as that term is commonly understood to be disclosure of your personal data in exchange for money. We may also share with others certain personal data we have collected from you for cross-context behavioral advertising (targeted advertising).
Notwithstanding the contrary, we will not sell your Sensitive personal data if you are a Maryland resident. Also, if you are a Maryland resident who we know or should know is under 18 years of age, we will not process or sell your personal data for the purposes of targeted advertising.

International Transfer of Your Personal Data
Subject to the terms of any engagement agreement or other agreement that we have with you, we allow McGuireWoods Consulting’s offices, branches and associated firms, to access your personal data, and may allow access to your personal data, or parts of it, to our service providers required to obtain the services we need to operate our business or to provide legal services to our clients.
McGuireWoods Consulting, McGuireWoods LLP (based in the United States), and McGuireWoods London LLP share infrastructure, personnel and providers of services in connection with the services we provide and marketing activities that we undertake. McGuireWoods Consulting also provides client and support services to McGuireWoods LLP, McGuireWoods London LLP, and other offices located outside the EEA. As a result, McGuireWoods LLP and its offices in the United States may receive and have access to your personal data.
Many of our third-party service providers are based outside the EEA so their processing of your personal data will involve a transfer of your personal data outside the EEA.
Whenever we transfer your personal data out of the EEA, where required by law, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

What Rights Do I Have in Relation to My Personal Data?
Depending on the facts and circumstances related to the personal data we collect or obtain about you — including, for example, the nature of the information we process, where you are located or reside, or whether we obtain the information in connection with legal services we provide to our clients — you may have rights regarding the personal data we hold about you afforded under relevant data protection laws. These may include the right to request information about, or access to, the personal data we hold, and rights to complain about how we handle your personal data. McGuireWoods Consulting is committed to honoring rights you have been afforded under data protection laws while ensuring that such rights are exercised in accordance with our other legal and ethical obligations. At that point if you believe our decision related to your request was in error, you may have the right to submit an appeal using the method(s) above. If the result is the same, you can also seek assistance and/or redress from your state attorney general.

Right to Request Under the GDPR
Under certain European data protection laws and certain conditions, you may have the right to request from McGuireWoods Consulting, among other things:
- Access to certain information concerning your personal data and the way we are processing it;
- Rectification of inaccurate or incorrect personal data;
- Erasure or restriction of inaccurate, incorrect personal data or personal data unlawfully processed;
- To stop certain processing, at any time, on grounds relating to your particular situation, including profiling, and to stop any processing, at any time, where it relates to direct marketing; and
- To receive your personal data in a structured, commonly used and machine-readable format, enabling you to transmit the personal data to another data controller.
For more information on the full extent of your rights or to exercise your rights, please contact your local data protection officer by mail or e-mail at the addresses indicated above with a brief explanation of your request. When exercising any of those rights, please let us:
- Have enough information to identify you;
- Have proof of your identity and address (a copy of your driver’s license or passport and a recent utility or credit card bill); and
- Know the information to which your request relates.
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask for further information in relation to your request to speed up our response.
If you would like to unsubscribe from any email publication you can also click on the “unsubscribe” button at the bottom of the relevant email publication. It may take up to 10 days for you to be removed from the applicable distribution list.
You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
Right to Complain Under the GDPR
We hope that we can resolve any query or concern you raise about our use of your personal data. However, if you believe your personal data is unlawfully processed by McGuireWoods Consulting under applicable European data protection laws, you may lodge a complaint with the relevant supervisory authority where you work, normally live or where any alleged infringement of data protection laws occurred. What Are My Rights as a California Resident Under the California Consumer Privacy Act, As Amended by the California Privacy Rights Act (CCPA)?
California Privacy Rights
California consumers have certain rights under the CCPA, which are described below. Please note that these rights are subject to certain exceptions and certain of these rights are subject to verification mechanisms under the CCPA.
- Right to Know/Access Personal Information Collected About You. You have the right to know: (1) the categories of personal information we have collected about you; (2) the categories of sources from which the personal information is collected; (3) the business or commercial purpose for collecting personal information; (4) the categories of third parties to whom we disclose personal information; and (5) the specific pieces of personal information we have collected about you.
- Right to Know Personal Information Disclosed, and to Whom. You have the right to request that we disclose to you: (1) the categories of personal information that we collected about you; and (2) the categories of personal information that we disclosed about you for a business purpose and the categories of persons to whom it was disclosed for a business purpose. However, McGuireWoods does not sell or share your personal information.
- Right to Request Deletion of Your Personal Information. You have the right to request that we delete your personal information. Following receipt of a request, we will let you know what, if any, personal information we can delete from our records. If we cannot delete all of your personal information, we will let you know the reason.
- Right to Correct Inaccurate Information. If you believe that any of the personal information we maintain about you is inaccurate, you have the right to submit a request for us to correct that information. Upon receipt of a request, we will use commercially reasonable efforts to correct the information as you direct.
- Right to Opt Out of the Sale and Sharing of Your Personal Information. You have the right to opt out of the sale or sharing of your personal information. McGuireWoods does not have actual knowledge of the sale or sharing of personal information of minors under the age of sixteen (16) years old. To opt out of the sale/sharing of your personal information, select Do Not Sell or Share My Personal Information.
- Right to Limit the Use of Your Sensitive Personal Information. You have the right to request that we limit the use or disclosure of your sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected. However, McGuireWoods does not process sensitive personal information in a manner that gives rise to this right.
- Right to Non-Discrimination for Exercising Your Rights. If you choose to exercise any of your rights, you have the right to not receive discriminatory treatment by us.
Your Rights If You Are a Resident of Any State Other than California
Depending on your state of residency, you may have certain rights related to your personal data. California residents should refer to the “Your Rights if You Are a Resident of California” section above and for a description of California specific rights and Nevada residents should refer to the “Nevada Privacy Notice” below.
Please note that not all of these rights may be applicable to you, these rights are subject to certain exceptions and certain of these rights are subject to verification mechanisms.
- The Right to Know. You have the right to know whether we are processing your personal data.
- The Right of Access. You have the right to access your personal data, and to obtain a copy of it in a readily usable format, if feasible.
- The Right to Correct Inaccuracies. You may request that inaccuracies in your personal data be corrected.
- The Right to Delete. You have the right to request that your personal data be deleted, except in cases where retention is required, for example, by law or contractual obligation.
- The Right to Data Portability. You have the right to obtain a copy of your personal data in a portable and, if feasible, readily usable format.
- The Right to Opt-Out. To the extent applicable, you may elect to prevent your personal data from being:
(1) Used in targeted advertising;
(2) Sold; or
(3) Used for automated decision making or profiling purposes that may produce legal or similarly significant effects.
- The Right to Non-Discrimination for Exercising Your Rights. If you choose to exercise any of your rights, you have the right to not receive discriminatory treatment by us.
- Rights Regarding Sensitive personal data. Depending on your state of residency, we will either: (a) not process your Sensitive personal data without first presenting you with clear notice and an opportunity to opt out of the processing; or (b) not process your Sensitive personal data without obtaining your consent. You have the right to withdraw your previous consent and opt out of further processing of your Sensitive personal data.
Furthermore, if we have actual knowledge that you are 13 years of age and not older than 18 years of age, we will not without your consent process your personal data for the purposes of targeted advertising, profiling in furtherance of decisions that produce legal effects or effects of similar significance or selling your personal data.
Rights of Nevada Residents
If you are a consumer in the State of Nevada, you may request to opt out of the current or future sale of your personal information. We do not currently sell any of your personal information under Nevada law, nor do we plan to do so in the future. However, you can submit a request to opt out of future sales by contacting us at info@mwcllc.com. Please include “Opt-Out Request Under Nevada Law” in the subject line of your message.
How to Exercise Your Rights
You may submit requests regarding your rights described above, by emailing your request to info@mwcllc.com or contacting us by phone at 1-800-775-2202.
To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with the requests to know, delete and/or correct. Our verification procedure may differ depending on the nature of your relationship to the firm, and the request you are making. The following generally describes the verification processes we use:
- For requests to know categories of personal information, we will verify your identity to a reasonable degree of certainty by matching at least two data points provided by you with reliable data points maintained by us.
- For requests to know specific pieces of personal information, we will verify your identity to a reasonably high degree of certainty by matching at least three data points provided by you with reliable data points maintained by us. We may also require a declaration, signed under penalty of perjury, that the person requesting the information is the person whose information is the subject of the request or that person’s authorized representative. We will maintain all signed declarations as part of our records.
- For requests to correct or delete personal information, we will verify your identity to a reasonable degree or a reasonably high degree of certainty depending on the sensitivity of the personal information and the risk of harm posed by unauthorized deletion. We will act in good faith when determining the appropriate standard to apply.
If there is no reasonable method by which we can verify your identity, we will state so in response to a request to know or delete personal information, including an explanation of why we have no reasonable method to verify your identity.
If you use an authorized agent to submit a request to know, delete or correct, we may require the authorized agent to provide proof that you gave the agent signed permission to submit the request. We may also require you to do either of the following: (a) verify your own identity directly with us; or (b) directly confirm with us that you provided the authorized agent permission to submit the request. This requirement does not apply if you have provided the authorized agent with power of attorney pursuant to Probate Code sections 4121 to 4130.
We will respond within 45 days of receipt of your request to know or request to delete. If we cannot verify your request within 45 days, we may deny your request. If necessary, we may take up to an additional 45 days to respond to your request but in such an event will provide you a notice and an explanation of the reason that we will take more than 45 days to respond to your request.
How Do You Protect My Personal Data?
McGuireWoods Consulting employs industry-standard best-practice protection to safeguard the personal data it collects.
Security Measures
McGuireWoods Consulting has implemented security-by-design infrastructure utilizing technologies such as firewalls, intrusion detection systems, anti-malware detection, data loss prevention, zero-day threat protection, and endpoint encryption. Our security measures include:
- Offering encrypted email using Transport Layer Security (TLS) within Microsoft Exchange. Other types of encryption are also available.
- Delivering systems that guarantee confidentiality screening for specific lawyers and matters pertaining to certain clients. This screening capability is also available for any matter for which higher levels of confidentiality are required by clients. This provides only individuals who have a “need to know” access to information about client matters.
- Providing a secure, encrypted file transfer solution, known as MWFiles, that allows very large files to be transferred back and forth between McGuireWoods Consulting and clients.
- Requiring multifactor authentication for remote access into McGuireWoods Consulting’s systems for all employees.
- Utilizing external security experts to conduct annual security audits of our environment, including penetration testing and social engineering testing.
- Performing regular security audits of McGuireWoods Consulting’s service providers to ensure client information is handled with appropriate safeguards.
- Employing advanced threat intelligence to stay abreast of emerging threats in the ever-changing security landscape.
- Conducting weekly vulnerability assessments of all McGuireWoods Consulting systems to ensure that new threats are addressed quickly and completely.
What if I do not Want to Provide My Personal Data?
For clients of McGuireWoods Consulting, prospects, job candidates, and providers, it is in your discretion to provide personal data to us. However, for us to enter into a contract with you, or other professional, employment or business relationship with you, we will need to obtain certain information, including personal data that may be necessary or legally required. If you do not provide us with all or some of the personal data we request, we may be prevented from entering into a contract with you, providing you with legal services, hiring you for employment, or sending you marketing information or other communications that you have requested.
For users of the website, providing your personal data is purely voluntarily. Not providing such data may only prevent you from receiving information from McGuireWoods Consulting. Analytical information captured during your visit to our website is described in our Cookies Policy.
