May 22, 2013 NC Governor McCrory Signs Landmark Wind Energy Legislation On Friday, May 17, Governor Pat McCrory signed five bills into law, including a landmark wind energy bill that creates a framework for the establishment of wind energy facilities in North Carolina. McGuireWoods and McGuireWoods Consulting were instrumental in expediting the wind energy legislation at the state level to protect a client's interests from existing federal regulations. May 16, 2013 Special Edition of the NCGA Week in Review This morning the House announced their comprehensive tax reform plan. The plan would reduce personal and corporate income tax rates while expanding the sales tax to cover more services. Under the plan, there would only be a single income tax bracket, and the sales tax would be reduced from 6.75 to 6.65 percent. Automobile repairs, warranty contracts, and several other services would be subject to sales tax under the plan. May 14, 2013 MACPAC - April Meeting Summary The Medicaid and CHIP Payment and Access Commission (MACPAC) was established in the Children's Health Insurance Program Reauthorization Act of 2009 (P.L. 111-3) and was later expanded and funded through the Patient Protection and Affordable Care Act (P.L. 111-148). MACPAC is tasked with reviewing state and federal Medicaid and CHIP access and payment policies and making recommendations to Congress, the Secretary of Health and Human Services (HHS), and the states on a wide range of issues affecting Medicaid and CHIP populations, including health care reform. On April 11-12, the Commission met in Washington, D.C. to discuss its upcoming report to Congress, due in March. May 8, 2013 Special Edition of the NCGA Week in Review Yesterday President Pro Tempore of the NC Senate, Senator Phil Berger announced the beginning of the Senate's plan for an overhaul of the state's tax code. If passed, this would be the first reform of the tax code since the 1930s. The actual language of the proposed legislation is expected to be released in the two weeks. April 25, 2013 MedPAC - April Meeting Summary The Medicare Payment Advisory Commission (MedPAC) is an independent Congressional agency established by the Balanced Budget Act of 1997 (P.L. 105-33) to advise the U.S. Congress on issues affecting the Medicare program. On April 4-5, 2013, the commission met to discuss select policy initiatives. The meeting was divided into seven sessions. April 24, 2013 Maryland Approves Public-Private Partnership (P3) Legislation Legislation enhancing the public-private partnership (P3) process in Maryland will soon become law. Maryland Gov. Martin O'Malley signed HB560 on April 9 after the bill passed the General Assembly earlier this month. The law, which goes into effect on July 1, is intended to spur private sector collaboration on important infrastructure projects in Maryland. Lt. Gov. Anthony Brown, who spearheaded the effort to pass the legislation, noted in a statement that initial estimates have found that P3s could contribute between 6 to 10 percent of Maryland's $3.1 billion annual capital budget and create as many as 4,000 jobs. December 6, 2012 IRS Medical Device Tax Ruling Suits MWC Client When the Internal Revenue Service (IRS) issued its regulation to implement a new 2.3 percent gross sales tax on medical devices, McGuireWoods Consulting client, the American Orthotic and Prosthetic Association (AOPA) gained two victories. Most prosthetics will be exempt from the tax, and as important, component parts used to construct artificial limbs will be exempt in most situations. MWC Senior Vice President Stephanie Kennan helped AOPA develop a justification for their products and component parts to be considered exempt under the only statutory exemption from the tax. She also worked with the IRS staff to assist them in understanding the prosthetic sector's products and testified on behalf of AOPA at an IRS hearing on the proposed rule in May. September 14, 2012 Weekly Washington Healthcare Update Congress returned to Washington this week intent on passing a continuing resolution (CR) to keep the federal government funded beyond the expiration of the current fiscal year on Sept. 30. While the legislative calendar initially provided two weeks of votes in September, the House moved quickly this week to approve a CR before adjourning roughly half-way through the scheduled work for the month. Senate Majority Leader Reid indicated that the Senate will take up the House-passed CR next week and follow suit by adjourning in advance of the November elections as well. September 7, 2012 Weekly Washington Healthcare Update With both Republicans and Democrats concluding their National Conventions, officially naming their respective presidential tickets, and Congress's August district work period coming to a post-Labor Day close, the 2012 campaign season has shifted into overdrive. It is anticipated that Congress will vote on the CR when they return in September. If this occurs, this will avoid a government shutdown.
